and the lady said it was my fault:eek:

I was sitting at a stop sign at the bottom of a small hill and she hit me (the road were slick because of it snowing).

I was on the way to pick my daughter up from school because they were being dismissed 2 hours early because of the snow.

The lady came up to my window and said 'didn't you hear me beeping my horn - I couldn't stop' Well I am setting at an intersection with cars across from me lining up and I didn't know if it was them - beeping for the car in front to move or who it was. Well she then asks if there was any damage done to my truck - duh - I was still sitting in my truck - how was I supposed to know. Then she said that if everything was ok that we should go are way.

NO - I said, we need to call the police and take picture (mean while - I am still sitting in the truck trying to get a hold of my cousin to go pick up Lucy from school and to get a hold of husband to let him know what is going on)

She said she would call the police - she then came back to the truck and told me that the police wanted us to move the vehicles out of the way, I asked her what about pictures and she said that "WELL THAT IS WHAT THE POLICE TOLD ME TO DO AND TO TELL YOU" she then stomped back to her van. Well I move the truck a few feet to it out of the way. The police came and took the info. I finally got out of the truck to look and there is some minor damage done to the right side of the bummer and side of the truck - just a little. After the police exchanged info with us, the lady left and I locked the truck up and walked home - oh, I didn't tell you that this happen at the end of my street - just 4 house between my house and the intersection. I was just to shook up to drive the truck around the corner and try to park it back on the hill, so I just walked home.

Wow, I'm sorry! I can't believe she tried to blame you for her hitting you! I mean were you driving her car, uh no. :D I hope you're ok though!!!

I'm okay - just shooked up

My truck is a piece of sh** (even before this accident) but I love it.

That's pathetic!!! She KNEW the roads were slick -- why didn't she start breaking sooner??? And the fact that she suggested just letting it slide if there was no damage raises some major red flags ... the common situation like that means that either 1) she has been in several fender benders before and didn't want to risk having another one showing up on her record, OR 2) she was hoping to nail you after for it by calling the police and her insurance and saying you left the scene of an accident ...

Maybe I'm just a cynic, but I've seen both situations happen more than once!!
 
Teresa - sounds like it is 100% her fault and she knows it and is just trying to rattle you. I would have told the police about everything she said and her rude behavior towards you after she hit you and/or at least let your insurance company know that. If you were at a complete stop at a stop sign, you have the right to be there and could not move into traffic to endanger people. Even if you could you don't HAVE to. I hope you are o.k. physically and her insurance company takes care of your truck.

Glad to hear you are ok I had the same thing happen to me when I was 16 I drove home and told my dad about it he called the guy and he said it was my fault dumb guy backed into me but after my dad threatend to go to the police he offered to pay for the damage. Never got fixed though.
 
Glad you are ok. Accidents are always scary...no matter what happens! Good thing you called the police, too...never know what kind of scam they may be trying to pull on you otherwise!

Since she rear ended you, she is at fault. At least you got a police report and the insurance compines will handle it. HER insurance company will pay for it!!! Don't let her get away with it!!

Brings a funny story to mind ... I had just learned to drive standard transmission (stick shift), and was pulling out of our mall parking lot, which had a small hill leading up to the road. Well, I rolled back ever so slightly (about a foot) and ended up bumping the guy who had pulled up behind me. He got out and started screaming at me about stupid women drivers and how I was going to pay for all the damages (not a scratch!) ... Well, there was a gal getting into her car close to us who had witnessed the whole thing. She told him flat out that if he was going to call the police and make such a huge issue out of it, he had better have his facts straight ... that he was following too close!!! He started into her, demanding to know who the @()%*@#)_%(*@# she thought she was telling HIM how to drive. She took off her jacket and revealed her MTO shirt ... she is one of the driver examiners ... and is married to a cop!!! You should have seen how fast that guy took off!!!!! Made my week!!!!

Update

Talked with insurance company real early this morning

Insurance adjuster was here just a few minutes

Truck will be fix – will get rental during that time

It will all be under HER insurance policy – not mine

I do have some pain in the lower neck (no – not husband – he is pain in the ***)

But I am doing fine

Glad that they found her at fault - duh, she slid into you. I hate driving on hills for this very reason when it snows.

I was in a car that rear ended a truck. Both the driver and I and the two witnesses to the accident all said that the guy had no tail lights or turn signal (he was at a dead stop trying to turn left). Since there was no evidence since the truck was smashed up, my friend was at fault because he rear ended the truck. Crazy situation, life lesson to always wear my seat belt (I was 15 and dumb at the time).

Glad to hear things are being handled.My SIL was driving not far from her home. A lady pulled out from a side street and hit her vehicle hard enough to rip off one of the back doors (mere inches from my niece in her car seat). The lady got out and started yelling at my SIL that it was her fault because she didn't stop. My SIL yelled back that she didn't have to. It wasn't a 4-way stop. There was no stop sign at that intersection on the road on which my SIL was driving. Thankfully, no one was hurt. My SIL said the woman was just plain rude the whole time, though. Some people!
 
Things usually work out so much faster when it's the same insurance company. They know they are paying it anyway, so there is no one to argue with.
 
I'm so sorry this happened to you, but glad insurance is coming through!I had an incident happen when had insurance co's roadside assistance tow Ye Olde Escort in for repairs.Picked it up and there was a dent that wasn't there, two RED scratches on the bumper ... and the plastic panel on the back was all smashed in! Repairman said he saw the damage .. but didn't flag down the driver just because he hadn't seen my car before and thought the damage was pre-existing!Called the tow provider ... he denied EVERYTHING. Never mind that his truck was red!Called roadside assistance ... he made me get an estimate and photos ... an hour after he saw the $850 estimate he called me to say since I didn't SEE the driver inflict the damage, he couldn't see asking him to pay for it!He suggested calling my insurance company. HELLO? That's what I thought I DID!Insurance company said I can't file a claim because I don't have full coverage.Next call is to Roadside Guy's SUPERVISOR.

Update again

I went to the hospital after my husband got home from work because my left arm was hurting really bad - at first they were thinking it was my blood pressure but after getting to the hospital - the bp was a little high but not bad

Did a CAT scan and x-rays of my arm, shoulder and neck. I have strained muscles and ligaments. They told me that it can take of to 3 days for injuries to show up with an accident like this. They also said that it will get worse before better. I am to rest for the next week and not to lift anything over 3 pounds for the next month. Well - Lucy will have to pour her own milk until then - she just loves for cereal.

But I am doing fine. I will take a pain pill and go to bed.

Oh Goodness! Please take it easy! I'm glad you got checked out at the hospital. Do some slow exercises with your neck and shoulders rolling them back and forth, side to side. I teach P.E. and even though it hurts it does help. Just go slowly. FEEL BETTER SOON!!!

This is exactly what the doctor told me and the nurse gave me two pages of exercises for me to do until I see my PCP.
